What Happened in This Pedestrian Accident

The accident happened on April 4, 2017 in Monroe County, and involved injuries to Stephen Kanyuck (then 72 years old) and his son Stanley Kanyuck (then 43 years old).

While driving in the parking lot of an Ahart’s Market, Agnes Hamilton (then 80 years old) hit the accelerator rather than the brake. Her Nissan SUV struck a shopping cart corral and parked vehicles, pinning both Stephen and Stanley in the process.

Injuries Sustained in the Accident

As a result of this pedestrian crash, Stephen suffered multiple leg fractures and contusions. Stanley suffered multiple fractures as well as additional leg and ankle injuries. The accident left Stanley permanently disabled, and he now requires the aid of a cane to walk. The injury impacted his job as a security guard.

Pre-Trial Settlement and a Lawsuit Against Progressive

Hamilton settled with the Kanyucks prior to the trial.

Because of Stanley’s permanent disability from the accident, he requested $702,000 in lost future earnings from Progressive, his own auto insurance provider. Progressive argued that despite Stanley’s injuries, he could still earn money through various types of non-strenuous labor.

Rather than accept Progressive’s offer, Stanley went to trial with representation from the Foley Law Firm in Scranton.

A $1 Million Verdict on Behalf of Our Client

A Monroe County jury ultimately found on behalf of Stanley in this case. The initial offer from Progressive was just $100,000 of their $325,000 in total coverage. They will now be asked to award Stanley with $1.05 million.

Foley Law Firm also recently took another case to trial on behalf of an injury client against State Farm Insurance. State Farm offered just $40,000 on up to $100,000 in coverage; the jury found in favor of our client, awarding $800,000.
